DMCA Copyright Policy
Herb Butter ("we," "us," or "our") respects the intellectual property rights of others and is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act ("DMCA"). This policy outlines the procedures for copyright holders to notify us of alleged infringement and for users to respond to takedown notices.
It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. We will take appropriate action, which may include removing or disabling access to the allegedly infringing content and, in appropriate circumstances, terminating the accounts of repeat infringers.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on our services infringes your copyrights, you may submit a written notification pursuant to the DMCA by providing our Copyright Agent with the following information:
- Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing: Provide a description of the material that you claim is infringing and sufficient information to permit us to locate the material on our site (e.g., URL of the specific page where the material is located).
- Information reasonably sufficient to permit us to contact you: This includes your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
Please send your DMCA notice to our designated Copyright Agent via our contact page, clearly indicating "DMCA Copyright Infringement Notice" in the subject line or message body.
DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include the following:
- Identification of the material that has been removed or to which access has been disabled: Provide the URL or other unique identifying information of the material that was removed or disabled.
- A statement, under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number: Sufficient information to allow us to contact you.
- A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which Herb Butter may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your electronic or physical signature: A physical or electronic signature.
Please send your counter-notification to our designated Copyright Agent via our contact page, clearly indicating "DMCA Counter-Notification" in the subject line or message body.
Please be aware that false counter-notifications may carry significant legal penalties. The DMCA allows us to restore the removed content if the party who submitted the original DMCA notification does not file an action seeking a court order against you within 10-14 business days of receiving the counter-notification.
